1. Acceptance of Terms

By installing, accessing, or using the Smart AI Poster Chrome extension ("the Extension" or "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not install or use the Extension.

2. Service Description

Smart AI Poster is a Chrome extension that provides:

  • Bulk Posting: Post content to multiple Facebook groups simultaneously
  • AI Content Rewriting: Generate unique variations of your content using AI
  • Scheduling: Schedule posts for future publication
  • Group Management: Organize and manage your Facebook group lists
  • Usage Tracking: Monitor your posting activity and limits

3. Eligibility

To use Smart AI Poster, you must:

  • Be at least 13 years of age
  • Have a valid Google account for authentication
  • Have legal capacity to enter into binding agreements
  • Comply with all applicable laws and regulations

If you are under 18, you must have parental or guardian consent to use this Service.

4. Account and Authentication

4.1 Account Creation

Authentication is handled through Google OAuth. By signing in, you agree to:

  • Provide accurate account information
  • Maintain the security of your account
  • Accept responsibility for all activity under your account

4.2 Account Restrictions

You may NOT:

  • Share your account credentials with others
  • Create multiple accounts to circumvent usage limits
  • Transfer or sell your account

5. Subscription Plans

5.1 Free Plan

  • 20 posts limit (lifetime)
  • Basic posting features
  • No AI rewriting
  • No credit card required

5.2 Pro Monthly - $7/month

  • Unlimited posts
  • 50 AI rewrites per day
  • Post scheduling
  • Priority support
  • Auto-renews monthly

5.3 Pro Lifetime - $29 (one-time)

  • Unlimited posts
  • 50 AI rewrites per day
  • Post scheduling
  • Lifetime updates
  • Priority support

6. Payments and Billing

6.1 Payment Processing

All payments are processed by Paddle, our Merchant of Record. Paddle handles billing, taxes, and payment compliance. We do not store your credit card information.

6.2 Subscription Renewal

Pro Monthly subscriptions automatically renew each month until canceled. You will be charged on the same day each month.

6.3 Refund Policy

  • 14-day money-back guarantee for first-time purchases
  • Refunds are available if you have not extensively used paid features
  • Once you actively use Pro features, the refund right may no longer apply
  • Lifetime purchases are non-refundable after 14 days

6.4 Cancellation

  • You may cancel your subscription at any time
  • Access continues until the end of the current billing period
  • No partial refunds for unused time

7. Acceptable Use

You agree to use Smart AI Poster responsibly and legally. You may NOT use the Service to:

  • Violate Facebook's Terms of Service or Community Standards
  • Post spam, unsolicited advertisements, or repetitive content
  • Harass, abuse, threaten, or harm others
  • Post illegal, fraudulent, or deceptive content
  • Impersonate others or misrepresent your identity
  • Distribute malware, viruses, or harmful code
  • Scrape or harvest data from Facebook
  • Circumvent usage limits or security measures
  • Reverse engineer, decompile, or modify the Extension
  • Resell, redistribute, or sublicense access to the Service

Violation of these terms may result in immediate account termination without refund.

8. User Content

8.1 Your Rights

You retain full ownership of all content you create and post using Smart AI Poster. We do not claim any ownership rights over your content.

8.2 License to Us

By using the AI rewriting feature, you grant us a limited, temporary license to process your content solely for the purpose of generating variations. This content is not stored permanently.

8.3 Your Responsibility

You are solely responsible for the content you post, including its legality, accuracy, and compliance with Facebook's rules and applicable laws.

9. Intellectual Property

9.1 Our Rights

Smart AI Poster, including its code, design, features, and branding, is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or create derivative works
  • Reverse engineer or decompile the Extension
  • Remove or alter any copyright notices
  • Use our branding without permission

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not guarantee:

  • Uninterrupted or error-free operation
  • Compatibility with future Facebook updates
  • Protection against Facebook account restrictions or bans
  • Specific results from using the Service
  • Accuracy of AI-generated content

Facebook may change its platform at any time, which could affect the Extension's functionality.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are NOT responsible for any Facebook account restrictions or bans
  • We are NOT liable for lost data, revenue, or business opportunities
  • We are NOT responsible for content posted using the Service
  • We are NOT liable for third-party services (Google, OpenAI, Paddle, Facebook)
  • Our total liability is limited to the greater of: (a) the amount you paid us in the last 12 months, or (b) $100 USD

You assume full responsibility for compliance with Facebook's terms and the consequences of your posts.

12. Indemnification

You agree to indemnify, defend, and hold harmless Smart AI Poster and its team from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Content you post using the Service
  • Violation of these Terms
  • Violation of any third-party rights
  • Violation of Facebook's terms or policies

13. Termination

13.1 By You

You may stop using the Service at any time by:

  • Uninstalling the Chrome extension
  • Canceling your subscription (if applicable)
  • Requesting account deletion via email

13.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Use the Service for illegal purposes
  • Fail to pay subscription fees

Termination for violations does not entitle you to a refund.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@smartaiposter.com and attempt to resolve the dispute informally for at least 30 days.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than court proceedings. Arbitration will be conducted in English under ICC rules.

14.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

16. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated version number and effective date. Continued use of the Service after changes constitutes acceptance of the new Terms.

For significant changes, we will notify you via email or extension notification at least 14 days before the changes take effect.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart AI Poster regarding the Service and supersede all prior agreements.
